Terms of service

Who this is between

These terms are between Kargozi, operated from Tamil Nadu, India, and the company whose workspace you are using. Creating a workspace or signing in accepts them. If you are doing that on behalf of a company, you are confirming you may bind it.

What the service is

Kargozi is software for running a cargo and courier desk: bookings, carrier rate cards, GST invoices, purchases, receipts and customer balances, in one place. We provide the software. We are not a courier, a freight forwarder, a customs agent or a tax adviser, and nothing here makes us any of those.

Trial, subscription and payment

• Every plan starts with 14 days free. No card is needed to begin.
• After the trial, a flat monthly price per workspace. Not per booking, not per shipment — the number of consignments you run does not change the bill.
• Fees are stated exclusive of GST, which is added where applicable.
• Subscriptions renew for the same period until cancelled. You can cancel at any time and keep access until the end of the period you have paid for.
• Paid fees are not refundable for a period already begun. If we get something badly wrong, talk to us — we would rather resolve it than hide behind this line.
• If we change the price, existing customers get at least 30 days’ notice by email before it applies to them.

Your account

You are responsible for who you invite into your workspace and what permissions you give them, and for keeping sign-in credentials to yourself. Turn on two-factor authentication. If you think an account has been compromised, remove its access and tell us.

A workspace owner can see and change everything in that workspace, including records created by other members. That is the design, not a defect.

Your data

The records you enter remain yours. You give us only the permission we need to run the service for you: to store that data, process it, back it up, and show it to the people you have invited. We do not sell it, and we do not use it to train anything.

You can export your data, and you can ask us to delete it. See the privacy policy for the detail.

You are responsible for having the right to hold the personal data you enter about your own customers and their recipients, and for what you ask us to do with it.

What the software will not do for you

This section exists because these are the misunderstandings that actually cause trouble.

• Invoices and tax. Kargozi produces GST invoices from the rates, charges and tax details you configure. Whether those are the correct rates for a given consignment, and whether the resulting document satisfies your obligations, is your responsibility and your accountant’s. Check your numbering series and your tax settings before you issue anything to a customer.
• Carrier bookings. When you dispatch to a carrier, we pass on exactly what you entered. A wrong weight, address or contents description produces a wrong airway bill, and the carrier’s own terms then govern that shipment — including its charges, delays, losses and claims. We are not a party to it.
• Rates. Cost and sell rates are yours to load and keep current. We do not verify them against a carrier’s published tariff.

Acceptable use

Do not use Kargozi to:

• break the law, or move goods you are not permitted to move;
• store data you have no right to hold;
• attack, overload or probe the service, or try to reach another workspace’s data;
• resell or rebrand the service as your own without a written agreement with us.

Security research is welcome. Tell us what you found before you tell anyone else, and do not test against a workspace that is not yours.

Availability and support

We aim to keep Kargozi available and we take backups, but this is not sold with a formal uptime guarantee. Planned maintenance is announced where we can. Support is by email, in business hours, in English.

Suspension and ending the agreement

• You can stop whenever you like. Cancel, or ask us to close the workspace.
• We may suspend a workspace for unpaid fees after telling you, or immediately where use is illegal or is threatening the service for other customers.
• If we ever discontinue the service, you get at least 60 days’ notice and an export of your data.
• After closure we delete your workspace data. Take your export first — once it is gone we cannot bring it back.

Warranties and liability

The service is provided as it is. We do not warrant that it will be uninterrupted or free of faults, and to the extent the law allows we exclude implied warranties.

We are not liable for lost profits, lost business or indirect losses. Where we are liable, our total liability is capped at the fees you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited — including for fraud.

Changes to these terms

We will update the date at the top when these change, and email the workspace owner before a material change takes effect. Continuing to use Kargozi after that accepts the new version.

Governing law

Indian law applies, and the courts of Tamil Nadu, India have exclusive jurisdiction. Before going anywhere near a court, email us — most of what reaches that point started as something we could have fixed in a week.
